Downsizing as a result of foreign trade

Trade Adjustment Assistance (TAA)

TAA is a federal program that assists workers who have lost their jobs as a result of foreign imports/exports of products or services by providing affected workers with opportunities to obtain training, resources and support to become reemployed. The program is offered at no cost to the employer.

If a company is downsizing as a result of foreign trade, a petition is filed at the U.S. Department of Labor. A petition may be filed through one of four ways: a company official, a state TAA representative, two or more workers or a union representative. If the department determines criteria has been met to certify the petition, individual workers at that company who are impacted can apply for benefits offered by TAA.

Worker Adjustment and Retraining Notification (WARN) Act

The U.S. Department of Labor WARN Act requires covered employers to give workers written notice at least 60 calendar days before plant closings and mass layoffs. A WARN notice must be provided to either affected workers or their representatives, the Idaho dislocated worker unit and to the appropriate unit of local government.
